§1 General provisions
The subject of these Regulations is to define the rules of sale and operation of the Online Store at www.caprice.com.pl.
The owner of the online store registered at www.caprice.com.pl is CPRC EWA BERNACIAK NIP 725 139 07 69 REGON 381746626, 90-553, Łódź, ul. Mikołaja Kopernika, No. 64A, office 29,
The online store sells goods via the Internet, through the online store system available at www.caprice.com.pl.
Placing an effective order is possible only after accepting these Regulations.
The Regulations are part of the contract concluded between the Seller and the Customer pursuant to art. 384 of the Civil Code.
The Buyer should be understood as any natural or legal person or an organizational unit without legal personality that has legal entity entitling it to perform independent legal actions in accordance with the law and has its own e-mail account.
A Consumer should be understood as a natural person purchasing products in the Online Store pursuant to the provisions of Art. 221 of the Civil Code.
The provisions of the Act of May 30, 2014 do not apply to entities other than Consumers. on consumer rights. The Seller is not liable under the warranty for physical and legal defects of the product in relation to persons or entities that are not Consumers.
The information contained on the Seller's website constitutes an invitation to conclude a contract within the meaning of art. 71 of the Civil Code, but do not constitute an offer within the meaning of Art. 66 of the Civil Code.
The seller on the website of the store presents digital photos of products, making every effort to ensure that the photos are of the highest quality and that they best reflect the actual condition and colors of the presented products.
The photos on the website of the store are the intellectual property of the Seller within the meaning of the Act of February 4, 1994 on copyright and related rights.
Prices in the Seller's Online Store are given in Polish zlotys (PLN), euro (EUR) or in US dollars (USD) and are gross prices, i.e. they include all components, including applicable taxes.
The Seller reserves the right to change the prices of products on the Seller's Online Store website, introduce new products, remove unavailable products, carry out and cancel promotional campaigns and make other changes.
Orders are accepted through the shop system available on the website at www.caprice.com.pl. When placing an order, please fill in the required fields correctly in accordance with the instructions on the online order form.
The available product size table is available at www.caprice.com.pl/strona/sizechart.
It is possible to place an order for a product on the Seller's Website of a non-standard size individually by sending an inquiry to the following e-mail address: email@example.com.
The Seller reserves the right not to make a non-standard product size if the technical and design conditions of the product do not allow it, and to change the price of a non-standard product if additional costs are associated with its production.
The distance purchase / sale contract between the Seller and the Buyer is concluded when the purchasing process defined in the order form of the shop system located at www.caprice.com.pl is correctly completed.
The Seller undertakes to provide the Buyer with brand new goods, free from technical and legal defects and legally marketed. The Consumer's obligations end upon receipt of the goods and payment of the entire price, in accordance with these Regulations, subject to the obligations incumbent on the Consumer in the event of a complaint or withdrawal from the contract.
In the event of unavailability of the ordered product, the Seller undertakes to inform the Buyer about this fact within no more than 14 working days from placing the order. The Buyer is obliged to make a decision on how to perform the remaining part of the order - partial execution, cancellation of the entire order and refund, extension of the waiting time for the order, replacement of the missing product.
The proof of purchase of the goods is the e-mail confirming the purchase of the product on the website www.caprice.com.pl, which the customer receives to the e-mail address provided by the consumer when placing the order.
Payment for the order can be made via PayPal, Shoplo Payments, provided by BlueMedia, cash on delivery and by card in the following systems:
- Visa Electron
- MasterCard Electronic
The goods are delivered in the manner specified in the order. Shipments delivered are by a courier company selected by the Seller. The shipment is sent no later than 14 business days from the date of receipt of the payment on the Seller's bank account or in the case of selecting the "cash on delivery" payment option after completing the ordering process.
The cost of foreign shipping is determined individually through the shop system available at www.caprice.com.pl.
The Seller is liable to the Consumer if the sold item has a physical or legal defect (warranty).
The seller is released from liability under the warranty if the consumer knew about the defect of the product at the time of concluding the contract.
If the sold product has a defect, the Consumer may submit a specific declaration of price reduction or withdrawal from the contract, unless the Seller immediately replaces the defective product or removes the defect.
If the sold product has a defect, the Consumer has the right to demand that the item be replaced with a non-defective one.
The consumer cannot withdraw from the contract if the defect is irrelevant. If only some of the products for orders have defects, the Consumer has the right to withdraw from the contract only in the case of defective items.
A consumer submitting a complaint should send a complaint statement, proof of purchase of the product and transfer details to the following e-mail address: firstname.lastname@example.org, and then send the purchased goods in a package with the note COMPLAINT to the following address:

The claim should contain: Product name with a short description, order number, data of the claimant (name, surname, address, telephone number, e-mail) along with a detailed description of the physical defects of the goods under complaint.
The Seller undertakes to reimburse the consumer for the costs related to the return of the defective goods, immediately after considering and taking into account the Consumer's claims under the warranty for defects in the goods.
If it is not possible to repair or replace the purchased goods with a new one, the Seller will inform the Consumer about the possibility of replacing the goods with another.
After receiving the parcel, the Consumer is obliged to check it in the presence of the deliverer and in the event of any mechanical damage caused during transport, prepare a protocol signed by the Consumer and the deliverer.
Complaints are considered within 14 business days from the moment the product is delivered to the address indicated by the Seller.
The Consumer will be informed about the results of the complaint by the Seller by e-mail.
If the complaint is considered positively and the Consumer does not take advantage of the option to replace the product with a new one or another product, he will receive a refund of the order value to his bank account within no more than 14 working days.
§4 Return and exchange
Based on Article. 27 of the Act of 30 May 2014 on consumer rights, the Consumer has the right to withdraw from the contract within 14 days from the date of release of the product without giving any reason.
When returning the goods, the buyer is obliged to send the seller an unambiguous statement of withdrawal from the contract containing: information on withdrawal from the contract with reference to the above act, order number, date of order, name, surname and address of the consumer and the bank account number return made to the e-mail address: email@example.com and return the goods along with the receipt, parcel with the note RETURN to the following address:

The goods returned by the consumer should be undamaged, along with tags and string seals. If you have hygiene stickers, they should be intact. The goods must be in their original packaging.
In the event of withdrawal of the contract under the terms of §4 point 1 of the Regulations, the Seller and the Buyer are obliged to return everything that they received from the other party under the concluded contract.
The costs of returning the product are the responsibility of the Consumer.
In the event of withdrawal from the contract, the Seller returns to the Consumer all payments no later than 14 business days from the moment of receiving the return of the goods. The reimbursement will be made using the same payment methods that were used by the Consumer in the original transaction, unless the Consumer expressly agrees to a different solution.
The consumer, with the consent of the Seller, may, within 14 days from the date of receipt of the product, replace it with another. In this case, the Buyer should contact the Seller via the following e-mail address: firstname.lastname@example.org.
The right to withdraw from the contract is not entitled to the Consumer in the case of:
Provision of a non-prefabricated product, manufactured according to the consumer's specifications or serving to meet individual needs
Orders of non-standard products at the special request of an individual customer (technical changes, non-standard size)
Destruction, damage to the product, or if it has clear traces of use by the Consumer despite not breaking pl string ombuses, labels and hygiene stickers.
§5 Protection of personal data
Providing personal data by the Buyer is voluntary, however, their absence prevents the implementation of the order. By making a purchase, the Buyer agrees to the collection, processing and use of personal data by the Seller for the purpose and to the extent necessary for the Seller to perform the order (i.e. to deliver the shipment to the Buyer and make settlements).

The data will be processed in compliance with all security requirements specified in the Act of August 29, 1997. on the protection of personal data (Journal of Laws of 2002, No. 101, item 926, as amended) and in the implementing regulations issued on its basis.
The Buyer has the right to freely access their personal data, correct them, as well as demand to stop processing them and remove them from the database, which should be reported in writing to the Seller at the following e-mail address: email@example.com.
The buyer may or may not agree to receive advertising and promotional materials via e-mail.
§6 Final provisions
All disputes between the Consumer and the Seller are first dealt with in an amicable manner pursuant to Art. 1831 and following of the Code of Civil Procedure.
The law applicable to the assessment of the legal relationship based on these Regulations is Polish law.
In matters not covered by these Regulations, the provisions of the Civil Code and other laws shall apply
